By applying to or participating in the Rise Up Eight Affiliate Program (the "Program"), you ("Affiliate," "you") agree to these Terms & Conditions (the "Terms").

 

1. Enrollment and approval

The Program is invitation-only. Applying does not guarantee acceptance. We approve or decline each applicant at our sole discretion, and we may end your participation at any time as described in Section 12. You must be at least 18 years old and able to enter a binding agreement.

2. How you may promote

You agree to promote Rise Up Eight honestly and in your own authentic voice. Specifically, you will:

 

• Make clear, conspicuous disclosure of the affiliate relationship wherever you share a link or code, consistent with FTC guidelines (for example, "I may earn a commission if you enroll, at no extra cost to you").
• Direct people to the free intro lesson or the official enrollment page, and let them decide for themselves.
• Comply with all applicable laws in how you promote, including CAN-SPAM if you use email and applicable privacy laws.
• Use only the marketing assets we provide, or your own honest description of the course and your experience with it.

3. Prohibited conduct

You agree that you will not:

 

• Refer your own purchases for commission (no self-referrals).
• Bid on or use "Rise Up Eight," "Speak with Confidence," our other course names, or confusingly similar terms in paid search, paid social, or domain names (no brand bidding).
• Send unsolicited bulk messages (spam) or post on deal, coupon, or discount-code sites.
• Offer unauthorized discounts, rebates, or cash-back on our products.
• Make false, misleading, or unsubstantiated claims, including income claims, guaranteed-outcome claims, or any medical, clinical, or therapeutic claim about performance anxiety or its treatment.
• Use cookie stuffing, forced clicks, or any method that records a referral the customer did not knowingly initiate.
• Misrepresent your relationship with Rise Up Eight, impersonate us, or speak on our behalf.
• Reproduce substantial portions of The 5-Day Stage Fright Solution or our proprietary course content, or misrepresent the READ method.

 

Violation of this section may result in immediate termination and forfeiture of unpaid commissions.

4. Tracking and attribution

Referrals are tracked through your unique referral link and, where issued, your vanity code, using our affiliate system on riseupeight.com. A referral cookie lasts 60 days from the customer's first click. A sale is credited to you when our system attributes it to your link or code under our standard tracking rules. Only sales properly recorded by our system are eligible for commission. We do not commit to honoring referrals that our tracking does not capture (for example, where a customer clears cookies or uses a different device or browser).

5. Commissions

For each eligible, completed sale of Speak with Confidence:

Commissions are one-time, calculated on the price actually paid (after any discount), and exclude taxes, fees, and shipping. We may update tiers, prices, and commission rates prospectively; changes do not affect commissions already earned.

6. Refunds and chargebacks

Speak with Confidence carries a 60-day money-back guarantee. Because of this:

• A commission is earned only after the referred sale has cleared the 60-day guarantee window.
• If a referred sale is refunded, charged back, or otherwise reversed within that window, the related commission is not payable.
• Because we pay only after the window closes, there is normally no clawback of money already paid to you. If a chargeback or fraud is discovered after payment, we may offset the amount against future commissions.

7. Payment terms

• Method: PayPal. You are responsible for providing and maintaining a valid PayPal account.
• Schedule: monthly, covering eligible commissions that have cleared the 60-day window.
• Minimum payout: $50. Balances below the minimum roll forward to the next period.
• Taxes: you are responsible for all taxes on your commissions. US-based affiliates must provide a completed Form W-9 before payment, and we may issue a Form 1099 where required. Non-US affiliates are responsible for their own reporting and any required forms.

8. Partner bonus for your audience

As an approved partner, students who enroll through your code or link may receive a free preview copy of the all-new edition of Dr. Fish's award-winning book, Speak, Perform & Compete with Confidence, subject to availability. Rise Up Eight controls the content, format, and fulfillment of this bonus and may modify or withdraw it on prospective notice. (The Reader's Favorite 5-star award was earned by the original edition, The 5-Day Stage Fright Solution.)

9. License and intellectual property

We grant you a limited, non-exclusive, revocable license to use the Rise Up Eight name and the marketing assets we provide, solely for the purpose of promoting the course during your participation. You may not alter our logos or trademarks, register them, or use them in any way that implies endorsement beyond an affiliate relationship. The READ method, course materials, and book remain our property. This license ends automatically when your participation ends.

10. Independent contractor

You are an independent contractor. Nothing in these Terms creates an employment, agency, partnership, or joint-venture relationship. You have no authority to bind Rise Up Eight or to make any representation, warranty, or promise on our behalf.

11. Confidentiality and student data

The Program does not give you access to students' personal data. If you nonetheless receive any customer or student personal information through your participation, you will keep it confidential, use it only as permitted, and not sell or share it.

12. Term and termination

Either party may end your participation at any time, with or without cause, by notice (email is sufficient). On termination, you must stop using our name, links, codes, and assets, and your referral links may be deactivated. Eligible commissions that have already cleared the guarantee window will be paid on the normal schedule, except that commissions tied to fraud or a material breach of these Terms are forfeited.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated version and, for material changes, make reasonable effort to notify active affiliates. Continuing in the Program after an update means you accept the updated Terms.

14. Disclaimers and limitation of liability

The Program is provided "as is." We do not guarantee any level of traffic, referrals, or earnings. To the fullest extent allowed by law, our total liability to you relating to the Program is limited to the total commissions we paid you in the [three] months before the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

15. Indemnification

You agree to indemnify and hold harmless Rise Up Eight, LSoF LLC, and its members and contractors from claims, losses, and expenses (including reasonable legal fees) arising from your promotional activities, your content and claims, or your violation of these Terms or applicable law.

16. Governing law and disputes

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. The parties will first try in good faith to resolve any dispute informally. Any unresolved dispute will be handled in the state or federal courts located in Durham, North Carolina, and you consent to that jurisdiction.

17. General

These Terms are the entire agreement between you and Rise Up Eight regarding the Program and supersede prior discussions. If any provision is found unenforceable, the rest remains in effect. We may assign these Terms; you may not assign them without our written consent. Our failure to enforce a provision is not a waiver of it.
