Enrollment and approval<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The Program is invitation-only. Applying does not guarantee acceptance. We approve or decline each applicant at our sole discretion, and we may end your participation at any time as described in Section 12. You must be at least 18 years old and able to enter a binding agreement.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">2. How you may promote<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">You agree to promote Rise Up Eight honestly and in your own authentic voice. Specifically, you will:<\/span><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Make clear, conspicuous disclosure of the affiliate relationship wherever you share a link or code, consistent with FTC guidelines (for example, \"I may earn a commission if you enroll, at no extra cost to you\").<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Direct people to the free intro lesson or the official enrollment page, and let them decide for themselves.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Comply with all applicable laws in how you promote, including CAN-SPAM if you use email and applicable privacy laws.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Use only the marketing assets we provide, or your own honest description of the course and your experience with it.<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-weight: 400;\">3. Prohibited conduct<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">You agree that you will not:<\/span><\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Refer your own purchases for commission (no self-referrals).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Bid on or use \"Rise Up Eight,\" \"Speak with Confidence,\" our other course names, or confusingly similar terms in paid search, paid social, or domain names (no brand bidding).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Send unsolicited bulk messages (spam) or post on deal, coupon, or discount-code sites.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Offer unauthorized discounts, rebates, or cash-back on our products.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Make false, misleading, or unsubstantiated claims, including income claims, guaranteed-outcome claims, or any medical, clinical, or therapeutic claim about performance anxiety or its treatment.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Use cookie stuffing, forced clicks, or any method that records a referral the customer did not knowingly initiate.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Misrepresent your relationship with Rise Up Eight, impersonate us, or speak on our behalf.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Reproduce substantial portions of <\/span><i><span style=\"font-weight: 400;\">The 5-Day Stage Fright Solution<\/span><\/i><span style=\"font-weight: 400;\"> or our proprietary course content, or misrepresent the READ method.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Violation of this section may result in immediate termination and forfeiture of unpaid commissions.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">4. Tracking and attribution<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Referrals are tracked through your unique referral link and, where issued, your vanity code, using our affiliate system on riseupeight.com. A referral cookie lasts <\/span><b>60 days<\/b><span style=\"font-weight: 400;\"> from the customer's first click. A sale is credited to you when our system attributes it to your link or code under our standard tracking rules. Only sales properly recorded by our system are eligible for commission. We do not commit to honoring referrals that our tracking does not capture (for example, where a customer clears cookies or uses a different device or browser).<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">5. We may update tiers, prices, and commission rates prospectively; changes do not affect commissions already earned.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">6. Refunds and chargebacks<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Speak with Confidence carries a 60-day money-back guarantee. Because of this:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A commission is earned only after the referred sale has cleared the 60-day guarantee window.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If a referred sale is refunded, charged back, or otherwise reversed within that window, the related commission is not payable.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Because we pay only after the window closes, there is normally no clawback of money already paid to you. You are responsible for providing and maintaining a valid PayPal account.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Schedule:<\/b><span style=\"font-weight: 400;\"> monthly, covering eligible commissions that have cleared the 60-day window.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Minimum payout:<\/b><span style=\"font-weight: 400;\"> $50. Balances below the minimum roll forward to the next period.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Taxes:<\/b><span style=\"font-weight: 400;\"> you are responsible for all taxes on your commissions. US-based affiliates must provide a completed Form W-9 before payment, and we may issue a Form 1099 where required. Independent contractor<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">You are an independent contractor. Nothing in these Terms creates an employment, agency, partnership, or joint-venture relationship. You have no authority to bind Rise Up Eight or to make any representation, warranty, or promise on our behalf.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">11. Confidentiality and student data<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The Program does not give you access to students' personal data. If you nonetheless receive any customer or student personal information through your participation, you will keep it confidential, use it only as permitted, and not sell or share it.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">12. Term and termination<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Either party may end your participation at any time, with or without cause, by notice (email is sufficient). On termination, you must stop using our name, links, codes, and assets, and your referral links may be deactivated. Eligible commissions that have already cleared the guarantee window will be paid on the normal schedule, except that commissions tied to fraud or a material breach of these Terms are forfeited.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">13. Changes to these Terms<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">We may update these Terms from time to time. We will post the updated version and, for material changes, make reasonable effort to notify active affiliates. Continuing in the Program after an update means you accept the updated Terms.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">14. Disclaimers and limitation of liability<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The Program is provided \"as is.\" We do not guarantee any level of traffic, referrals, or earnings. To the fullest extent allowed by law, our total liability to you relating to the Program is limited to the total commissions we paid you in the [three] months before the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">15. Indemnification<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">You agree to indemnify and hold harmless Rise Up Eight, LSoF LLC, and its members and contractors from claims, losses, and expenses (including reasonable legal fees) arising from your promotional activities, your content and claims, or your violation of these Terms or applicable law.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">16. Governing law and disputes<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. The parties will first try in good faith to resolve any dispute informally. Any unresolved dispute will be handled in the state or federal courts located in Durham, North Carolina, and you consent to that jurisdiction.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">17. General<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">These Terms are the entire agreement between you and Rise Up Eight regarding the Program and supersede prior discussions. If any provision is found unenforceable, the rest remains in effect. We may assign these Terms; you may not assign them without our written consent.
